This website and online store are operated by Ofori's eksport & import. Throughout these Terms of Service, the terms “we,” “us,” “our,” and the “Company” refer to Ofori's eksport & import.

We provide access to this website, our online store, product information, content, functions, tools, checkout services and related customer services. These are collectively referred to as the “Services.”

The technical e-commerce infrastructure for our online store is provided by Shopify.

These Terms of Service govern your access to and use of the Services, including purchases made through our online store.

Our:

  • Return and Refund Policy;

  • Shipping and Delivery Policy;

  • Payment Policy; and

  • Other policies displayed through our online store

may also form part of the agreement between you and us.

We do not guarantee that the color displayed on every device will exactly match the color of the physical product.

6. Product Availability

Adding an item to a shopping cart does not reserve the product or guarantee that it will remain available.

A product may become unavailable before an order has been accepted or dispatched.

If an ordered product becomes unavailable, we may, where appropriate:

  • Cancel the affected item;

  • Contact you for instructions;

  • Offer a suitable alternative with your agreement; or

  • Refund the amount paid for the unavailable product.

We will not substitute a materially different product without appropriate customer agreement.

7. Placing an Order

Submitting an order through our online store constitutes an offer to purchase the products selected by you.

An automatic order confirmation or acknowledgment normally confirms that we have received your order. It does not necessarily mean that the order has been finally accepted.

A binding purchase agreement will generally be formed when we:

  • Confirm acceptance of the order;

  • Otherwise clearly communicate that the order has been accepted.

  • Applicable purchase limits have been exceeded;

  • Delivery to the supplied address is unavailable;

  • A product cannot legally be supplied to the destination; or

  • Processing the transaction would violate applicable law.

Where payment has already been collected for an order that we cancel, the relevant amount will be refunded using the original payment method or another appropriate refund method.

9. Personal and Lawful Purchases

Unless otherwise agreed, products purchased through the Services are intended for lawful personal or household purposes.

You must not use the Services to make purchases for:

  • Fraudulent transactions;

  • Unlawful resale;

  • Illegal export;

  • Sanctions evasion;

  • Misrepresentation; or

  • Any other unlawful activity.

We may reasonably limit order quantities where necessary to prevent fraud, unauthorized resale or abuse of the Services.

10. Prices

Product prices are displayed through our online store.

The applicable price will normally be the price displayed when you submit your order.

Prices may change from time to time.

A later price change will not normally affect an order that has already been accepted.

We reserve the right to correct an obvious pricing error.

If a material pricing error affects an order, we may contact you and give you the option to:

  • Continue with the corrected price where legally permitted; or

  • Cancel the affected product or order and receive an appropriate refund.

11. Promotions and Discounts

Promotions, discount codes or special offers may be subject to additional conditions.

  • Maximum discount amounts;

12. Taxes, VAT and Additional Charges

Cross-border orders may be subject to:

  • Import taxes;

  • Customs clearance charges;

  • Handling charges; or

  • Other fees imposed by authorities in the destination country.

Where such charges are included in the purchase price, this will be stated during checkout.

Unless otherwise stated, customers may be responsible for taxes or import charges imposed independently by the authorities of the destination country.

Customers are responsible for ensuring that ordered products may lawfully be imported into their destination country.

13. Payment

Available payment methods will be displayed during checkout.

Only payment methods shown for the relevant order are available.

You agree to provide accurate and complete payment and billing information.

By submitting payment information, you confirm that:

  • You are authorized to use the selected payment method;

  • The information supplied is accurate; and

  • The applicable payment provider may process the transaction.

Payments may be processed by Shopify, banks, payment gateways or other independent payment service providers.

Where Cash on Delivery (COD) is offered during checkout, payment may instead be collected by the courier when the parcel is delivered.

The availability of payment methods may vary depending on:

  • Destination country;

  • Currency;

  • Product;

  • Order value;

  • Delivery provider; or

  • Other operational requirements.

We may delay or cancel an order if payment cannot reasonably be verified or authorized.

14. Cash on Delivery

Where Cash on Delivery is displayed during checkout, you may select this method for an eligible order.

Payment is then generally collected by the courier when the parcel is delivered.

Availability may depend on:

  • Country;

  • Postal code;

  • Product;

  • Order amount; and

  • Delivery provider.

We may perform reasonable verification before dispatching certain COD orders.

Repeated fraudulent or unjustified refusal of COD parcels may result in COD availability being restricted for future orders where permitted by law.

Nothing in this provision limits any statutory cancellation, withdrawal or consumer protection right.

15. Shipping and Delivery

Shipping and delivery are governed by our Shipping and Delivery Policy.

Delivery periods shown through our Services are estimates unless expressly stated otherwise.

Delivery may be affected by circumstances including:

  • Carrier delays;

  • Customs inspections;

  • Incorrect delivery information;

  • Severe weather;

  • Public holidays;

  • Transportation interruptions;

  • Regulatory restrictions;

  • Strikes;

  • Natural disasters; or

  • Other circumstances outside our reasonable control.

Customers are responsible for providing an accurate and complete delivery address.

If delivery fails because the customer supplied an incorrect or incomplete address, reasonable redelivery or reshipping costs may be charged where permitted by law.

For consumer purchases, the risk of loss or damage generally transfers when you, or a third party designated by you other than the carrier, take physical possession of the goods, subject to applicable law.

16. Returns and Refunds

Returns, exchanges and refunds are governed by our Return and Refund Policy.

Our voluntary commercial return policy provides additional return options and does not replace mandatory consumer rights.

Where a return request is made, customers should follow the return instructions provided through:

  • An available Shopify self-service return function; or

17. EU/EEA 14-Day Right of Withdrawal

Consumers in the European Union or European Economic Area who purchase eligible goods through an online or other distance-selling method generally have a statutory 14-day right of withdrawal, subject to applicable exceptions.

Where this statutory right applies:

  • You may withdraw without providing a reason;

  • You must notify us before the withdrawal period expires;

  • Goods must be returned within the applicable statutory period after notification; and

  • You are responsible for the direct cost of returning the goods where this responsibility has been properly communicated, unless mandatory law requires otherwise.

Where a product is defective, damaged, incorrectly supplied or otherwise non-conforming, reasonable return costs will be handled in accordance with our Return and Refund Policy and applicable consumer law.

This statutory right operates separately from our voluntary 30-day return policy.

18. Refunds

Approved refunds will generally be made using the original payment method unless:

  • Another method is agreed;

  • The original payment method cannot reasonably be used; or

  • Applicable law requires another method.

Refund processing time may depend on:

  • The reason for the refund;

  • Return inspection;

  • Payment method;

  • Date on which returned goods are received;

  • Date on which proof of return is supplied; and

  • Processing times of banks or payment providers.

Where a statutory withdrawal right applies, refunds will be processed within the legally required period.

Where legally permitted, we may withhold reimbursement until we receive the returned goods or sufficient evidence that they have been sent back.

For COD transactions, we may contact the customer to arrange an appropriate refund method because the original payment was collected physically.

19. Intellectual Property

Content available through the Services may be protected by copyright, trademark and other intellectual property laws.

Protected content may include:

  • Business names;

  • Logos;

  • Product names;

  • Product descriptions;

  • Photographs;

  • Graphics;

  • Videos;

  • Text;

  • Designs;

  • Website layouts;

  • Software;

  • Icons; and

  • Other website materials.

Such content may belong to Ofori's eksport & import, Shopify, our licensors, suppliers or other rights holders.

Unless otherwise authorized, you may use the Services only for lawful personal and non-commercial purposes.

You must not, without appropriate authorization:

  • Copy protected content;

  • Reproduce website materials;

  • Modify protected content;

  • Republish or distribute protected materials;

  • Sell or commercially exploit website content;

  • Remove intellectual property notices;

  • Misrepresent the origin of content; or

  • Use trademarks or other protected identifiers without permission.

Nothing in these Terms transfers ownership of intellectual property rights to you.

20. Customer Reviews and Submitted Content

Where the Services allow you to submit:

  • Reviews;

  • Comments;

  • Photographs;

  • Videos;

  • Suggestions;

  • Feedback; or

  • Other content,

you remain responsible for that content.

You confirm that content submitted by you:

  • Is accurate to the best of your knowledge;

  • Is owned by you or submitted with appropriate permission;

  • Does not violate another person's rights;

  • Is not unlawful;

  • Is not fraudulent or intentionally misleading;

  • Is not abusive, threatening or defamatory; and

  • Does not contain malicious software.

Where permitted by law, by submitting content you grant us a non-exclusive, worldwide and royalty-free license to use, reproduce, display, translate or adapt it for legitimate purposes connected with operating and promoting the Services.

You retain ownership of your original content.

We may remove or refuse content that violates these Terms or applicable law.

21. Third-Party Tools and Services

Our Services may contain functions, integrations or services supplied by third parties.

These may include:

  • Shopify;

  • Payment providers;

  • Analytics providers;

  • Delivery providers;

  • Marketing services; or

  • Other technical service providers.

Third-party services may be governed by their own terms and privacy policies.

We do not necessarily own or control independent third-party services.

To the extent permitted by law, we are not responsible for losses caused exclusively by an independent third party outside our reasonable control.

22. Relationship With Shopify

Our online store uses Shopify's e-commerce platform.

Shopify may provide technical functions including:

  • Store hosting;

  • Checkout technology;

  • Customer account functions;

  • Payment integrations;

  • Store management tools;

  • Security functions; and

  • Data-processing infrastructure.

Unless expressly stated otherwise, products purchased through our online store are sold by Ofori's eksport & import, not by Shopify.

Shopify is not the seller of the products merely because its platform is used to operate the online store.

Shopify may independently process certain personal information according to its own privacy documentation and applicable law.

23. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Our Privacy Policy explains matters including:

  • What personal information may be collected;

  • Why it may be processed;

  • How it may be used;

  • Who it may be shared with;

  • Data retention;

  • International transfers;

  • Cookies; and

  • Customer data protection rights.

24. Errors and Corrections

Information available through the Services may occasionally contain:

  • Cancelling the affected item and issuing a refund.

Nothing in this section limits mandatory consumer rights.

  • To interfere with website security;

  • To interfere with website performance;

We may use reasonable technical measures to prevent unauthorized automated access.

27. Suspension or Termination

We may suspend or terminate access to some or all of the Services where reasonably necessary because:

  • These Terms have been materially violated;

  • Fraud or unlawful conduct is reasonably suspected;

  • Website security is threatened;

  • An account creates a substantial risk to customers or third parties; or

  • We are legally required to restrict access.

Where reasonably possible and legally appropriate, we may provide notice before suspension or termination.

Termination does not affect rights or obligations that arose before termination.

28. Availability of the Services

We take reasonable steps to keep our online store available and functioning.

However, we cannot guarantee that the Services will always be:

  • Uninterrupted;

  • Free from temporary technical faults;

  • Free from every security risk; or

Nothing in this section excludes statutory rights relating to products purchased from us.

29. Consumer Guarantees and Statutory Rights

Nothing in these Terms excludes, limits or replaces mandatory consumer rights.

Depending on applicable law, these may include rights concerning:

  • Non-conforming products;

  • Incorrect product descriptions;

  • Statutory warranties;

  • Repair or replacement;

  • Price reductions;

  • Refunds;

  • Delivery obligations; and

  • Statutory withdrawal rights.

Where mandatory law provides greater protection than these Terms, the mandatory legal protection will apply.

30. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the relevant contract was formed.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or restricted.

This includes, where applicable, liability for:

  • Fraud;

  • Fraudulent misrepresentation;

  • Intentional misconduct;

  • Death or personal injury caused by negligence;

  • Gross negligence where liability cannot legally be limited;

  • Mandatory product liability; or

  • Violation of non-waivable consumer rights.

Mandatory consumer protection law will always prevail over any inconsistent limitation in these Terms.

31. Customer Responsibility for Breaches

To the extent permitted by law, you may be responsible for reasonable losses or claims resulting directly from:

  • Your unlawful use of the Services;

  • A material breach of these Terms;

  • Your infringement of another person's rights; or

  • Content submitted by you without the necessary rights or authorization.

You will not be responsible for losses caused by our own negligence, breach of contract or unlawful conduct.

32. Events Outside Our Reasonable Control

We will not be responsible for a failure or delay caused exclusively by circumstances outside our reasonable control.

These may include:

  • Natural disasters;

  • Extreme weather;

  • War;

  • Civil unrest;

  • Government restrictions;

  • Epidemics;

  • Strikes;

  • Transportation disruption;

  • Telecommunications failures;

  • Power outages;

  • Customs restrictions; or

  • Failure of critical third-party infrastructure.

Where such circumstances affect an existing order, we will take reasonable steps to minimize disruption and communicate with affected customers where appropriate.

Mandatory consumer rights remain unaffected.

33. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply to the maximum extent legally permitted.

Any invalid portion may be separated from the remainder of these Terms.

The remaining provisions will continue to apply.

34. No Waiver

If we delay or fail to enforce a right under these Terms, this does not necessarily mean that we have waived that right.

Any waiver must relate to the specific matter concerned and will not automatically apply to future situations.

35. Governing Law and Dispute Resolution

These Terms and purchases made through our online store are governed by the laws of Denmark, subject to mandatory consumer protection laws that may apply in your country of residence.

This choice of law does not remove mandatory consumer protection rights available to you under applicable European Union, European Economic Area or national consumer law.

If you have a complaint or dispute, we encourage you to contact us first so that we can attempt to resolve the matter directly.

  • An appropriate consumer dispute resolution body; or

  • A court with jurisdiction under applicable law.

Nothing in these Terms requires a consumer to waive the right to bring a claim before a court that has jurisdiction under mandatory consumer law.

  • Changes in technology;

  • Legal or regulatory requirements;

  • Security developments; or

  • Other legitimate operational reasons.

The current version will be published through our online store at coasz.shop together with its latest revision date.

Where legally required, appropriate notice will be provided before a material change takes effect.

Changes will not retroactively remove mandatory rights relating to a purchase contract that has already been completed.

Nothing in this section excludes information, representations or contractual rights that legally form part of a consumer purchase agreement.
